Founded in 1953 under the direction of Karl Siegfried Bader as the “Research Centre for Legal Language, Legal Archaeology and Legal Folklore”, the Centre for Research in the History of Law (CLHR) brings together activities in the field of legal history at the University of Zurich. Roman law, which in its final form, as compiled in Justinian`s Corpus Iuris Civilis, forms the basis of all the legal systems of continental Europe, is generally studied in isolation, as the sole source of our own legal thought. The seminar “Fictitious Loan in Antiquity” is aimed at students who are interested in Antiquity and ancient law. It will take place from 8 to 9 April 2022 at the central campus of the University of Zurich. Participation is possible in German or English and the thesis can also be written in one of the two languages. Unlike this idealized Roman law of the Romanist tradition, current Roman historical law emerged and developed as one of many other ancient legal traditions that was centuries and even millennia older than it. The course “Ancient Legal History” aims to explore these “other” legal traditions and their interaction with Roman law. Using examples from mesopotamian, Egyptian and Greek legal traditions, this course focuses on the actual legal practice of these ancient cultures, which have been passed on to us through countless documents, especially papyri from Greek and Roman Egypt. In addition, the course will also address the problems arising from Roman expansion: in particular, how Roman jurists, Roman courts and imperial bureaucracy dealt with a legal practice that, unlike Italy, was often still dominated by such non-Roman legal traditions in the provinces.
